Sweepstakes/Contest: Triumph Start Your Adventure Giveaway

CONTEST DATES:
Start Date: June 20, 2022, 8:00:00 AM Eastern Standard Time
End Date: October 31, 2022, 11:00:00 PM Eastern Standard Time
Entry Receipt Deadline: October 31, 2022, 11:00:00 PM Eastern Standard Time
Drawing Date: On or prior to January 31, 2023
Promotion Period: Start Date through End Date

ELIGIBILITY:

1. Void where prohibited, No purchase Necessary, Purchase will not improve chances of winning. All federal, state, and local regulations apply. Must be a legal resident of the 50 United States and the District of Columbia.

2. Must be 18 years old at the start of the contest. Must have a motorcycle endorsed valid driver's license in the state of residence.

3. Unless otherwise specified, employees, agents and affiliates of Triumph Motorcycles, Triumph Dealers, other motorcycle dealers, contest sponsors, and their immediate family members and household members are not eligible to participate or win contest.  The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others.

4. Must have valid email address and phone number. 

5. Potential contest winners will be selected by and at Triumph Motorcycles America, Ltd. in its sole discretion.  If it is determined by the Triumph Motorcycles America, Ltd that a candidate is not eligible to receive a prize, another candidate may be selected for eligibility consultation and this process will continue on until such time as an eligible candidate is found.  In the unlikely event that no candidates are found to meet the specifications, then the prize will go un-awarded. In the event of a tie, the winner will be determined by and at the sole discretion of Triumph Motorcycles America, Ltd. 

6. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in a given calendar year will be issued an IRS Form 1099 to report their winnings.

7. If the winner is a Canadian resident, that person must also correctly answer, within a 5-minute time period, a mathematical skill-testing question without the benefit of any calculating devices, before the prize will be awarded.

PRIZE:
Grand Prize: One (1) winner will be randomly selected from all entries to receive One (1) grand prize including a trip to the Jeff Stanton Adventure Experience including airfare, lodging for one night at Two Hats Ranch, ground transportation to and from Gerald Ford International Airport (GRR), and a 2-Day Tour/Adventure experience at Jeff Stanton Adventure Experience. Approximate retail value of the prize is $3,921.58 USD. A cash alternative will not be available. Failure to accept the prize will result in forfeiture of prize. Winner must provide acceptable riding gear.

HOW TO ENTER THE SWEEPSTAKES:
To enter the Sweepstakes, dealer will submit the form in full at a participating Triumph Motorcycles dealerships.

No Automated Entries. The use of any automated, programmed, robotic or similar system to enter is prohibited and will result in disqualification. Entries filled out by anyone other than you will be disqualified. Auto entries prohibited.

A maximum of two (2) submissions per person during the contest period will count towards entering the Sweepstakes.

THE SWEEPSTAKES DRAWINGS:
The drawing will be held on or before Tuesday, January 31, 2022. Odds of winning depend on the number of eligible entries received.

LIMIT ON ENTRIES:
Limit of a total of (2) entries per participant. Participant will receive one (1) entry with the demo ride of a model year 2023 Tiger 1200 family motorcycle, and one (1) entry with the demo ride of a model year 2022 Tiger Sport 660 during the contest period. No more than two (2) total entries will be accepted per participant. Additional demo rides will not result in additional entries. If a model is not available at a dealership participating in the contest the participant may receive the additional entry. 

ELIGIBLE DEMO MODELS:

At participating dealerships, Triumph Motorcycle Model Year 2023 Tiger 1200 GT, Tiger 1200 GT Pro, Tiger 1200 GT Explorer, Tiger 1200 Rally Pro, or a Tiger 1200 Rally Explorer. Model year 2022 Triumph Tiger Sport 660.

SWEEPSTAKES PRIZE NOTIFICATION:
Winners will be notified via email and/or phone call or text. Winner must respond within 72 hours of contact to claim prize. If the winner is unable to be reached in 72 hours, the winner’s entry will be forfeited, and a different name will be randomly selected. No additional entries will be considered for the winner that forfeited.

Winners may be required to execute and return an Affidavit of Eligibility and Release of Publicity (if permitted by law) and Liability ("Affidavit").

LIMIT ON PRIZES:
One (1) individual prize will be awarded throughout the promotional period.

You understand that you are providing your information to Triumph Motorcycles America Ltd.. The information you provide will be used for the Triumph Motorcycles America Ltd. Triumph Start Your Adventure Giveaway and Triumph Motorcycles marketing communications. All information provided is subject to Triumph Motorcycles America Ltd.'s Privacy Policy.

GENERAL CONDITIONS:
By participating, you accept and agree to abide by the Official Rules and all decisions of Sponsor and its judging and administration organizations, which are final and legally binding in all respects. No substitution or transfer to a third party of all or any part of prizes permitted. If, for any reason, a prize cannot be awarded or winner is not capable of redeeming a prize, Sponsor is not obligated to award it and Sponsor reserves the right, in its sole discretion, whether or not to substitute the prize (or portion of prize) with a prize of comparable or greater value or cash value. If, for any reason, more prizes are available or claimed than the stated number, Sponsor reserves the right to randomly draw winners from eligible prize claimants in such prize category. Winners are solely responsible for all federal, state, and local taxes, if any, on prizes and any expenses not specifically awarded in the Official Rules. Winner is responsible for claiming prize from Triumph Motorcycles America, Ltd.. Employees of Triumph Motorcycles America, Ltd. are not eligible to enter. Non-compliance with these Official Rules may result in disqualification. You are not a winner unless and until (A) your entry is received, (B) you have fully complied with the Official Rules and (C) all verification and award processes have been completed. Acceptance of prize constitutes permission for Sponsor and its designees to use winner's name and/or likeness for purposes of advertising and promotion in any medium, without further compensation, except as prohibited by law.

Unless otherwise stated, the odds of winning a contest depend on a number of factors, including but not limited to the number of eligible entries received and the number of listeners participating at any given time.

LIMITATION OF LIABILITY; RELEASE OF LIABILITY:
Sponsor, their promotion parties, promotion providers, and their respective affiliates, subsidiaries, parent companies, advertising and promotion agencies, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively the “Promotion Entities”) are not responsible for: any incorrect or inaccurate entry information; NONUSE OF PRIZE; human error; technical malfunctions; failures, omissions, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to your or any other computer relating to or resulting from participation in this Sweepstakes; inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, or any combination thereof. Online submission is not considered proof of delivery or receipt. All entries become the property of Sponsor and will not be returned.

By entering, you agree to release, discharge, indemnify, and hold harmless the Promotion Entities and their respective parent companies, subsidiaries, their respective representatives and agents, advertising and promotion agencies, promotion partners and prize suppliers, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against claims, actions, damages, losses, costs, expenses, attorney’s fees and court costs, or liability arising in connection with your participation and/or entry in the Promotion and/or your receipt or use of any prize awarded in this Promotion or due to any injuries, damages, or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, incidental and consequential, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Promotion. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the Promotion Entities to use said winner’s names, photographs, likenesses, statements, biographical information, voices, and city and state addresses on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.  If by reason of a printing or other error, more prizes are claimed than the number set forth in these rules, all persons making purportedly valid claims will be included in a random drawing to award the prize in question. No more than the advertised number of prizes will be awarded. You further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived.  You acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”  The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor. Sponsor and Released Parties shall not have any further liability to any participant in connection with the Sweepstakes.

TAMPERING/VIOLATIONS/DISRUPTION:
Sponsor may, in its sole determination, disqualify any person it believes may be tampering with the entry or other operation of the Promotion or acting in violation of the Official Rules, in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

CAUTION:
ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW.

CANCELLATION/MODIFICATION:
Sponsor may, in its sole discretion, cancel, terminate, modify or suspend the Promotion or modify the Promotion or Official Rules if the Promotion is not capable of running as Sponsor planned for any reason (including, but not limited to, due to tampering, unauthorized intervention, computer virus, fraud, technical or human error or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or intended conduct of this Promotion or amendment and/or adoption of new or existing laws and/or regulations regarding the administration, operation or any other aspect of the Promotion in any jurisdiction).

EMAIL ACCOUNT HOLDER:
If the holder of an email account is disputed, entry will be deemed made by the natural person who is assigned to the e-mail address by the internet access provider, online service provider or other organization (e.g., business, school, etc.) that assigns e-mail addresses for the domain associated with the e-mail address.

NO PRIZE WARRANTY:
WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR OF IMPLIED WARRANTIES. CHECK YOUR LOCAL LAWS. SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.

DISPUTES:
Promotion is governed by, and will be construed in accordance with, the laws of the state of Georgia. If not resolved through direct discussions, any claim shall be resolved by final and binding arbitration with an experienced arbitrator licensed to practice law in Georgia. The remedy for any claim shall be subject to all limitations and releases set forth in these rules, be limited to actual out of pocket damages, and shall not, in any event, include any punitive, exemplary, consequential, or incidental damages, attorney's fees or costs of bringing a claim, or any injunctive or other equitable relief.

PROMOTION ADMINISTRATION:
Sponsor is responsible for the collection, submission and processing of entries and the overall administration and execution of the Promotion. Entrants should look solely to Sponsor at its above address with any questions, comments or problems related to the Promotion.
